TERMS AND CONDITIONS
These Conditions represent Capri Homes terms of business and the basis upon which Capri Homes agrees to provide services in connection with the letting of residential accommodation and property or other specified ‘Services’ to guests and tenants to the exclusion of all other conditions of business.
TERMS OF BUSINESS
A minimum of three nights applies to all bookings. Guests and tenants of some properties will be required to complete a booking form and may also be required to enter into booking or rental agreements with relevant landlords in addition to their agreement with Capri Homes.
Any person booking on behalf of a guest or tenant shall be taken as booking as principal and is liable for the guest or tenant. Any such person agrees to indemnify Capri Homes for any breach, non‐payment, loss or damage caused by such guest or tenant.
Clients should be aware that they will be liable for any damages or breakages caused whilst in the accommodation. At some apartments a security deposit will be required in connection with the booking and the deposit shall be security for any damages or breakages caused to the accommodation. You will be notified if this is applicable
PAYMENT METHODS AND PROCEDURES
Deposit: Full payment is expected before check in. Almost in all cases, guests are expected to make full payment at least 7 days before check in date. Alternatively , a minimum deposit of 50% of applicable charges will be made by Guests, before Capri Homes can give a confirmed reservation of accommodation. The balance of 50% rental will be due on arrival of Guests. Payment delayed until arrival date is subject to availability of apartment because we could not guarantee availability when no payment has been made. Renewal: Reservation and payment should be made for the entire period of stay. Guests can extend their stay by giving notice and making payment by at least 7 days prior to original scheduled departure date. Such requests must be written, delivered and acknowledged by Capri Homes and appropriate payments must be paid at least 7 days to the expiration of current occupancy. Unless, this provision is complied with, no guarantee can be given to such requests for extension of stay. Approval of request for extension is at the discretion of Management.
1. Cancellation notice must be given at least 7 days prior to arrival date in a written form sent by e-mail by the person who originally made the reservation. Cancellation fee will be charged as follows:
– 30 days or more notice before arrival date………0%
– 7 to 29 days notice before arrival date…………….20% of rental cost
– 3 to 6 days notice before arrival date…………..…50% of rental cost
– No Show…………………………………………………………..100% of rental cost
2. In case of “No Show” and/or in the case where no written notice for cancellation is given for not more than 2 days prior to expected Check in date, the initial deposit will be forfeited.
3. In the unlikely case where we have to cancel the reservation for any reason, we will inform you and attempt to provide the guest in a suitable accommodation ofour own at a price equivalent to the original amount agreed. In any case, we will not be held responsible for any extra costs the guest bears over and above the original price agreed in securing alternative accommodation. When an alternative accommodation is impossible, we shall issue a full refund to any payments made to us.
If a guest will vacate the property before the end of the rental period reserved for him/her, we require:
– 60 or more days notice, guest will be charged for 2 weeks rental only and will collect remaining portion of unutilised balance,
– 30 to 59 days notice for 50% refund of unutilised balance.
– 0 to 29 days notice, the unutilized portion will be fully charged with Nil refund
CHECK IN / CHECK OUT
In most cases, check in is after 2.00 pm and check out is before 10.00 am. The keys are given to you on arrival at the address mentioned in your confirmation e‐mail and upon signature of your rental contract. The meeting point is normally the apartment itself; however, in some cases this may also be at the property manager’s office.
OPTION TO EXTEND
If an option to extend is required please state this under special requirements. If option to extend is requested, the following written notice is required in order to exercise the option;
For stays of up to 7 nights, 72 hours notice is required prior to scheduled departure date.
For stays of more than 7 nights, 1 week notice is required prior to scheduled departure date.
DISCLAIMER AND QUALITY
Capri Homes has taken reasonable care to ensure the quality of the accommodation and properties offered and cannot accept any liability for any dissatisfaction with regard to the properties. Unless expressly stated to the contrary by Capri Homes in writing, Capri Homes acts as an agent for principals.
Capri Homes reserves the right to alter prices or accommodation without notice due to circumstances beyond Capri Homes control. Capri Homes acts as an agent in good faith and cannot be held responsible for any acts/defaults caused by third parties or any legal liability of any landlord or owner.
Capri Homes does not warrant, guarantee or undertake any matters on behalf of any third party supplier or any landlord of any property. Details of the landlord or owner will be given on request.
Capri Homes acts as agent for landlords and owners of residential properties. Unless expressly stated to the contrary in
Writing, Capri Homes enters into contracts for the letting of property with guests or tenants either as agent for a named
Principal or as agent on behalf of an undisclosed principal.
In no circumstances will Capri Homes be liable to any tenant in respect of any property or relating to any damage or defect in the property, breach of any tenancy or letting agreement and any other breach by or on the part of the landlord Including the failure to return a deposit.
WARRANTIES AND LIABILITY
Capri Homes will provide the Services using reasonable care and skill. Except in respect of death or personal injury caused by Capri Homes negligence, or as expressly provided in these Conditions, Capri Homes shall not be liable for any direct, indirect or consequential loss which arises out of or in connection with the accommodation or the provision of the Services or their use. All other warranties terms and conditions, expressed or implied by statute or otherwise, are excluded to the fullest extent permitted by the relevant Nigerian law.
The entire liability of Capri Homes to any person shall not in any event exceed the amount of the charges paid to Capri
Homes. Capri Homes shall be fully indemnified by guests and tenants against any loss claim or liability whatsoever incurred or suffered by Capri Homes as a result of negligence or any default by any person, guest or tenant (or their employees, agents or representatives) of their obligations to Capri Homes however arising in connection with any property or the Services.
